Protection and Processing of Personal Data
In connection with the application, as of May 25, 2018, of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “GDPR“), the company F.P.H.U. MARKPOL Andrzej Satoła, with its registered office in Tarnawa, informs you that as of May 25, 2018, you are entitled to the rights specified below related to the processing of your personal data by MARKPOL.
At the same time, pursuant to Art. 13 of the GDPR, we inform you that as of May 25, 2018, the following information and principles regarding the processing of your personal data are in effect.
1. Data Controller The controller of your personal data is the company F.P.H.U. MARKPOL Andrzej Satoła, using the Tax Identification Number (NIP): 8681626531, with its registered office at Tarnawa 213, 32-741 Tarnawa.
2. Contact Point MARKPOL has designated a contact person for matters related to the processing of personal data, who can be contacted via email at: biuro@markpol-kontenery.pl
3. Purposes and Legal Basis for Processing Your personal data will be processed:
a) for the purpose of sending information and accounting documents related to the services provided (hosting, marketing, and others);
b) for the purpose of sending information and marketing content, provided you have given your consent – the legal basis for processing is the legitimate interest of MARKPOL (Art. 6(1)(f) GDPR); the legitimate interest of MARKPOL consists of sending marketing content during the period of providing electronic services or by mail;
c) for the purpose of fulfilling legal obligations incumbent on MARKPOL under generally applicable laws, including tax and accounting regulations – the legal basis for processing is Art. 6(1)(c) GDPR;
d) for analytical and statistical purposes – the legal basis for processing is the legitimate interest of MARKPOL (Art. 6(1)(f) GDPR); the legitimate interest consists of analyzing the results of the business activity;
e) for the purpose of pursuing the legitimate interest of MARKPOL involving the possible establishment, exercise, or defense of legal claims – the legal basis for processing is Art. 6(1)(f) GDPR.
4. Data Recipients The recipients of your personal data may include:
providers of IT systems, hosting services, and IT support;
entities providing accounting, debt collection, legal, analytical, and marketing services to MARKPOL;
postal operators and couriers;
electronic payment system operators and banks regarding payment processing;
authorities authorized to receive your personal data based on legal provisions.
5. Data Transfer to Third Countries MARKPOL will not transfer your personal data to third countries (outside the EEA).
6. Data Retention Period Your personal data will be processed:
in the case of data processed for the conclusion and performance of sales contracts – for the time necessary to perform all obligations resulting from the sales contracts;
in the case of data processed for the provision of electronic services – for the duration of the provision of electronic services;
in the case of data processed for marketing purposes – until you object to the processing of data in this scope;
in the case referred to in point 3(d) above – for the duration of the provision of electronic services;
in the case referred to in point 3(e) above – until the expiration of the statute of limitations for claims. After this period, data will be processed only to the extent and for the time required by law, including accounting regulations.
7. Profiling Your personal data will be subject to profiling.
8. Your Rights
Withdrawal of Consent: Each consent granted may be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. For evidentiary purposes, MARKPOL requests that consent be withdrawn in writing to the address (Tarnawa 213, 32-741 Tarnawa) or electronically (via email to biuro@markpol-kontenery.pl).
Access and Rectification: You have the right to access your personal data, rectify it, delete it, or limit its processing.
Complaint: You have the right to lodge a complaint with a supervisory authority responsible for personal data protection.
Data Portability: You have the right to data portability, which includes the right to receive the data and send it to another controller or to request, if technically feasible, that the data be sent directly to another controller.
9. Voluntary Data Provision Providing personal data is voluntary but necessary for the provision of electronic services or the conclusion and performance of sales contracts. The consequence of failing to provide the personal data required by MARKPOL is the inability to provide electronic services or conclude sales contracts.
10. Google Analytics and AdWords Every visitor to this website may be assigned a User-ID number within Google Analytics and Google AdWords. Your data in this regard may be further processed by GOOGLE IRELAND LIMITED, Address: 1st & 2nd Floor, Gordon House, Barrow Street, Dublin 4, Ireland.
